In this case the court found that although a police officer— who was later fired and pleaded guilty to simple assault charges—had no reason to shoot into a car leaving the Magic City strip club in 2015, claims against the city could not be sustained because there was no evidence “creating a genuine issue of material fact on whether the city acted with deliberate indifference.” The court further held that “Favors does not point to an officially promulgated policy by the city to support his claim.” As such the court found in favor of the city. Lawyers for Favors filed a notice of appeal on August 5, 2020.
